Emma has over 17 years’ experience working within the travel industry. Her specialist knowledge in travel law has been gained through working in-house for a number of leading tour operators, Lloyd’s insurers and Hextalls since 2009.

Emma also specialises in employment law, and regularly advises on settlement agreements, employee disputes, contract drafting and disciplinary matters as well as offering general employment advice. She is also available to conduct in-resort training and risk assessments for tour operators.

Recent cases include:

  • Chelton v Saga Holidays – Successfully defending a claim to trial by arguing that evidence of the local law is no substitute for evidence of the local standard.
  • Campbell v ST&H Ltd – Successful strike out of a claim under the Equality Act 2010 and its application to cruise ships.
  • Advising in a claim concerning the interaction of the Working Time Regulations and the National Minimum Wage Regulations and their application to care workers.
  • Defending a claim involving an accident in Kenya and recovery of a tour operator’s outlay from its supplier in the foreign jurisdiction.
  • Advising a tour operator client on various cases arising after an outbreak of legionnaires’ disease at a foreign hotel.
  • Advising a tour operator client on the rights of an employee’s partner to bring a claim under the Package Travel Regulations, where the holiday was provided through an employee benefits scheme.
